If Trump gets to name the successor to RBG, any good thing that gets through Congress will die, because that means appeasing both Gorsuch and Roberts, when the former will become the swing Justice. If you don't understand that, then you don't understand politics and need to listen to those who do. This is whether we are talking about centrists who want to go back to the Before Time, or people on the hard left who want to just throw it to Trump out of spite.

  3. The only leftward switch that I can think of (I am 40, so like the guest, the first SCOTUS appointee in my lifetime was O'Connor) is Breyer for White. Souter for Sotomayor seems to me to be a like-for-like switch.

  7. That's not what Bernie proposed at all. Bernie's proposal was to rotate federal circuit judges onto the Supreme Court.
