  1. When there was a talking filibuster, there was usually only about one per decade. If someone wants to keep talking, that person can try, but if the rule is changed from 3/5 of all Senators to 3/5 of voting Senators, that makes 41 Senators stand by for a vote. Let us not forget that the longest filibuster ever ultimately failed, because the Civil Rights Act of 1957 passed despite Thurmond talking for 24 1/2 hours.
