The problem with profiting from a negative is that then there might be an incentive to support/facilitate/stimulate that negative, now that might not be always possible (let's say someone profiteered from cold weather), but in this case it is (through not caring much about the "correction" aspect, lobbying for harsher sentences).

  2. "it's not like these for-profit prisons are actively increasing the prison" By not caring about rehabilitation and lobbying for hasher laws, what they do "passively" is bad enough. The issue is that their profit motive is something that is bad for society, they profit from a negative.
