No. Just like Israel, the US is a non-signatory that the ICC doesn't have jurisdiction over.

No, it's US foreign policy. He gave the pre-written response the US always has against the ICC going after non-signatory nations.

@worer850 Right. Gaza is under ICC jurisdiction, and that's how the ICC is trying to get at Netanyahu. Their prosecutor thinks he can pull it off. We'll have to see if it works. US foreign policy still opposes it, naturally. Because if they didn't, the ICC could try to go after the US for all the various countries it's invaded that ARE ICC signatories. Which, if it worked, would have every single US president, and most of their staff, up on charges.

@alexthefae Ukraine is, and is a US ally. So US foreign policy requires Biden defend Ukraine's interests. Plus Russia is a near peer nation, so the ICC probe hurts them. Stop expecting logic or morality, and remember the ONLY thing that matters in foreign policy is power.

@Hollywood041 True. The ICC, if it was ever able to go after US officials, wouldn't be able to go after them for what's happening with Israel. That's Israel's crime. Even if the US is theoretically enabling it (basically the dozens of nations that fund Israel are by that logic, the ICC would have to go after most developed nations). What the ICC COULD go after US officials for, is the US crimes in Afghanistan, Iraq, Vietnam, etc... all the nations the US destabilized and invaded.

@ojogbaneamedu2501 Yes and no. While the US will actively oppose the ICC going after allies (to prevent giving the ICC justification to go after the US), they will also oppose it for non-allies, because it keeps up the narrative that the ICC shouldn't go after non-signatories. At the same time, they DIDN'T oppose the ICC going after Putin, with the excuse that they're defending the rights of Ukraine, who is an ally. Plus, the US will pressure it's slave nations... I mean... allies... to also oppose the ICC, pushing the same narrative that it should be up to non-signatories to take care of their own.
