There’s a chance Disney could win based on this statement without the TOS which doesn’t protect them. Could be framed as neglect on the couples part consider that it is in a way true. If you have a life threatening condition and also being a doctor you would think they would know better.

@roadhoundd. that may be. But we have no clue what exactly happen. What food was ordered, what type of restaurant, was this a bakery? What this indoors or outdoors place? Was it the same staff they talked to or multiple? Here’s a little fun fact: certain allergies, Some foods can contain unwanted strains just as simple as through air from dust particles even without the food actually contain the ingredient. All we know she dies from allergies and that’s it. Without any context really.

@Fisthammet that’s debatable, depends on the cause of the neglect whatever if it was preventable or not. Some allergies can in fact be effected through air particles such as gluten. Sever cases of allergies only a simple strain can be enough without actually being added in the food. Than there’s often the fact that most menus contains the information what it contains and often costumers do deliberately order set menu they are allergic to be expected have a special treatment. In fact we have no idea if this was an indoor or outdoor facility nor what type of service it was. Was it a restaurant, fast food, bakery etc etc. but let’s say this was a 100% fault on staff. Than there should be a clear case of neglect which seems it isn’t based on the lack of information of it

Not that laws have ever prevented Disney to win at anything. Consider that Disney cooperate has a massive lobby firm that incentivizes their ability to bend rules and laws to their benefits and as we all know American politics are corrupt as hell
