  1. At 5:00 minutes Lorcán Price, mentions the EU 2008 policy on hate speech and so on. I want to say that the question of legitimacy here between consent and the policy, is not seen as something that must have a case by case agreement. Politics would be impossible, short of people voting on every full stop and comma. Where then is the legitimacy? Well there is the agreement by, or within an elected government to do policy parallel with the EU, this might even be obligatory on membership of the EU at some point in the process. The real material source is data ie evidence based policy, the massive organised networks of social psychological data measurement and recording and its organisation into a kind of audit. The justification for this process as it collects data on a population, is made kind of mythically analogous to a population presenting stuff or talking to the government. But of course it is not its a conflation and a confusion about behavioural data and freedom of speech in KANT'S SENSE. No one worries over this as a system and institutionality, especially the people who set up and run them, they themselves as subjects of data collection, are regulated but not by data methods internally i.e. data qua as their public role station and duty. They probably must pass though all kinds of test for bias as authorities. this policy is first evidence based as utilities, within a framework of Rights. Originally the EU talked a lot about Kant but not so much now. So the complex legitimacy structure is grounded in data. In the beginning is the hermeneutic history the notion of Right history and rights framed organised, not raw, data. the source of content for the systems and policy then is up stream to the policy presentation. it is classed as scientific data and so fact about a population's. Facts closer in ways to reflex and causal reaction rather than a reasoned choice and judgment and event of free speech. This aspect of Kant seems to have been taken over by absolute enlightenment thought of subjects as multiple statistical functions for properties as empirical data and rational structure. It what Wilfred Sellars called the scientific image of man. The reports you want then are from the European Union Monitoring Centre. A particularly pleasurable read is: "Activities of the European Monitoring Centre on Racism and Xenophobia in 2006". Enjoy the justification for this narrow frame of data selection. But the solution is to widen this to white men as that is what they are after its a trick to draw you into their entire system of utility and rights.

  2. At 8:00mins: I'm going out on a limb here but i think instead of a definition its a kind of Quineian (W, van O . Quine) aggregation of data with a Bayesian risk analysis, which has "citizen" as a legal formal ontology with the mass data as content. but the individual people do not appear in the mass data and Baysian analysis, social risk analysis replaces personal intention meaning and context of speech act. I'm sort of making an informed guess though. Orson Welles discussed this in a short program for TV on Passports in the 1950's i think, while he was moving around Europe "on the run" from Hedda Hopper and William Randolph Hurst. Joke but grain of truth.
