Jack Smith is not eligible to act in this capacity. Congress never created the office, and Smith was never confirmed by the Senate.

@rondaniels9974 Why do you think it was brought up in the hearing? There was no hearing appointing Jack smith and he was never confirmed by Congress per the Appointments clause of the Consitution. Either Biden appointed him and he was never confirmed and Garland doesn't have the authority in the appointments clause to appoint a Special Prosecutor. Congress NEVER established the "Office of Special Prosecutors". If Garland uses a special Council, it has to be from within the AG ofc.

@jeannerogers7085 Don't laugh. It was just confirmed in a Judiciary by Rep Massey. Appointments clause of the Constitution. Garland did not have authority to use Lying Jack Smith. Only a President can appoint ppl like Special prosecutors. Congress must establish the "Office" and Senate must confirm. They didn't. Read your Constitution.
