The driver is in the wrong. He was passing 100 feet before a curve by the double lines, he had to have heard the impact from the hit since it looked like the bike and rider hit the vehicle more than once. For all the people who say the bike should have been closer to the side of the road or wonder why the bike was even on on the road - get over it! The point is it was and can be on the road it is also a vehicle. This is nothing more than hit and run wither it was a car, truck, bike, person.
