The hearing has just adjourned for lunch. It is truly FRIGHTENING and every Australian should be taking notice. What is on trial is not Novak's direct covid risk, not he has broken any laws, not that he has made public statements undermining government efforts for covid ....... but simply the assumption that he THINKS differently to the official government line. I stress 'assumed' because the government actually hasn't asked him what he thinks. That's right, someone who has an ASSUMED 'thought' differently to the official position of the Australia Government has no place in Australia and needs to be deported. This is the stuff of the truly most oppressive regimes in history e.g USSR, China, East Germany.

Actually, its not even about being unvaccinated. It's that his mere presence in Australia as a high profile person who thinks differently to the official government line representing a 'challenge' to the official government line. Free 'thought' is current on trial on the Federal Court of Australia. It is fascinating viewing )if you can stand the lawyers waffle), but worth it being at the very heart of whether Australia actually has any democratic freedom at all.

@daedalron None of the issues you outline are being debated in the Federal Court. Its ALL about what the government assumes Novak thinks (they actually have asked him) as a high profile person about covid vaccination for himself. Freedom of THOUGHT is currently on trial.

@Joff RH Spare me the BS moralizing and virtue signalling. I've never met a person in my life that complies with ever law. And anyway, if you knew anything about this current matter you'd know that it has NOTHING to do with any laws being broken. It is ALL about whether a high profile person is allowed to be assumed to THINK differently to an official government position. If you believe that is appropriate them your are either a troll, fool, or likely both.

@Joff RH Novak has complied with ALL the appropriate laws of Australia. Neither of the court cases have disputed this FACT. Calling you either a troll, fool, or both is not meant to be an insult. Just another statement of fact.

@Critical-Thinker895 Your summation is correct, I watched the whole proceedings. The central case is the government assumes what Novak thinks (not what he actually thinks) MAY be detrimental to Australia, as it may (not even 'will') motivate a significant number of people to not get vaccinated. That's IT! That logic doesn't even stand up to the most basic of scrutiny. Those who want to get vaccinated will have done so by now, those who don't won't. What Novak may or may not think will have NO bearing on people's decisions. None! And for the government to try and imply otherwise demonstrates their utter contempt for the people who elected them.

@Critical-Thinker895 Even when the Chief Justice clarify what constituted "evidence" for the Federal Court was staggering. It isn't something that requires support by solid fact. Just an assumption by the Minister as to what the Australian public believe or will do, the application of "common sense" etc .... constitutes "evidence". The very foundation of scientific principal is NOT to rely on assumptions, gut feeling, I speak for everyone , etc...... but rather solid indisputable fact that can be tested.

@mrjonny6762 Not really, lots of winners (and a couple losers) out of this incident. Novak is a winner as he'll pick up millions of new fans from around the world. His sponsors will be winners due to all his new followers and increased public profile. The Australian people are winners because Morrison's handling of this mess makes it an absolute certainty now that his government will be totally smashed at the next election. Those opposed to mandatory vaccination are winners as this incident will galvanize them and stir them to greater civil disobedience. About the only losers are Scott Morrison, and Tennis Australia as their competition will now take on a pretty hollow tone which they won't be able to shake.

@mrjonny6762 Doubt Novak really cares. Does he need the money, no. Does he need the fame, no. Does he need more silver in on the shelf, no. The biggest looser is Scott Morrison.

No, the ruling of this court hearing before 3 judges is FINAL and can't be challenged by either party. That's the very reason the judge who was going to originally hear the case escalated it to a '3 judge hearing', so it can't be challenged again. The government had opposed this move so they could again challenge the outcome. That was denied, so this decision is final.

@rickrick5041 Well like MOST things that come out of CNN, they are WRONG! There very reason 3 judges are hearing this case is so no further appeal is possible by either party. The Chief Justice explained this in the very opening to the case today. It has been done to specifically block any further government appeal if the decision doesn't go their way. The government had objected to the court making this decision (hear the case by 3, not 1 judge).

@Joff RH And in true liberal democracy the government would respect their courts original decision. And the government wouldn't deliberately delay making a Ministerial decision for days (till mid Friday) for the sole purpose of denying Novak natural justice by trying to run him out of time. The Chief Justice was critical of the government on this tactic this morning. And the government wouldn't try and further frustrate the court by opposing 3 judges hearing the current case to prevent further government interference in their decision.
