Old fashioned in person voting has a "chain of custody" protocol designed to prevent selective counting. They can do whatever they want, but they can go to jail for it because somebody is WATCHING.

  3. All this caveat really means in this context is that the people who throw away valid ballots are breaking the law. We already knew that.

That is different from there being no protocol at all. Every human system is subject to betrayal. That is no excuse for not using the best safeguards available. "Didn't this country have recounts in elections before??? Sounds like someone went wrong somewhere at some point" Some states have automatic recount provisions when the count is close. Sometimes a campaign requests a recount. This is not an argument against using the most secure protocol exclusively.
