Styx is saying that government can't legally discriminate against gays, but churches and people can. This is almost entirely false. Firstly, there is no federal law banning discrimination based on sexual orientation, but there is now legal precedent: earlier this year, the U.S. Court of Appeals for the 7th Circuit decided 8-3 that discrimination on the basis of "sex" also means discrimination on the basis of "sexual orientation." This is clearly a judicial overreach, but this means that sexual orientation is covered under the Civil Rights Act. Before, this was a state issue. 22 states and countless local governments have enacted such laws, but Texas is not one of them. Secondly, the courts have ruled in favor of gay couples in lawsuits against for-profit churches and ordained minsters as well as private business owners that refused to serve homosexuals on religious grounds. If the church is not 100% non-profit under the tax code, and has any for-profit entity, they are subject to state and local non-discrimination laws, same as private business owners. As far as business owners are concerned, we all know the bakers in Colorado that were destroyed because of this.
