  1. OMG! The reason the defense can use that language is because it goes to Kyle's state of mind. That's what they were in HIS mind. Also Rosenbaum wasn't supposed to be near a child under the age of 18. So by going anywhere near Kyle, he violated his probation and was already wanted for violating bond on another charge.
