Where was this logic when kashmiri pundit exodus happened? Did the judiciaries' "suo moto" powers get curtailed by someone or was the judiciary unwilling to even acknowledge such a gross atrocity in independent India?

@shubhampathak4206 the supreme court and the constitution are not divine text beyond any criticism. The josh of the supreme courts from its handling of the HRCE issue to that of the kashmiri pundit issue is clear enough of how secular the judiciary is. The judiciary has not the spine or the goodwill to admit its negligence or even pursue remedial measures, as seen from hoe justice DY chandrachud + others quashed petitions for the investigation of the kashmiri pundit exodus. As for the constitution, it is enforced by "we the people" of India as mentioned in the preamble. It ought not be held hostage to the mistakes of long dead men or the clutches of a spineless partial judiciary. Retaliatory demolition is morally and constitutionally wrong. But if the Indian state is so incapable of maintaining law and order while secular liberals defend/ignore violent riots by islamic fanatics, then in that circumstance the mighty constitution and its protector the judiciary have already failed to acheive their purpose and should be reexamined to ensure peace. To me law and order, guarentee of a free and fair life without threat of communal violence, freedom of though and speech, are all much more important than a constitution conjured up 70 years ago. These are the values the constitution promise to uphold. The inability of the constitution and the judiciary in this regard is evident, and the only way forward is reforming both..

@shubhampathak4206 is that not the law of saudi arabia? Or is there some universal conception of law wnshrined in the fabric of the cosmos? Who are you to delegitimise the legal systems of foreign nations? And what is this modern idiocy of shared human values? That crap sprung from europe and now they reap its benefits from the influx of islamic migrants from the middle east.... The law of the land as you understand it is neither absolute nor above criticism. Just get down from your high horse and you will smell the blood piss and shit like the rest of us do.

@shubhampathak4206 when the judiciary and the state are incapable of enforcing law, then it is the duty of the individual to take law into his hands. I would rather be a living sinner than a murdered saint - that is the level to which your entire circus has gotten Indian society to...

@kalebj7001 what formal document have you got for such claims of "judicial doctrine"? The great milords cant even decide on how they are selected while mountains of pending cases keep pilkng up. Dont try selling this bullshit of judicial doctrine. This is the great judiciary that failed to even look into kashmiri hindu qenocide even after pleas were filed. They wont reform themselves, nor will they let anyone else do it - it will their ego and their "independence".
