  1. I agree that there is one very different aspect. This man used a deadly weapon, which risked severe injury or death to the other man; while the other may have misused a restraint technique, but did not intend to permanently harm the man. If both dead men behaved the same way, then the man and Penny were acting in a lawful manner.
