@nandy1256 Yes, after someone is charged and all the evidence is presented and witnesses are questioned. And it will usually be a jury.

@nandy1256 Their view is technically not illegal, but it violates due process. Ruling that someone engaged in, or aided and abetted, an insurrection without due process of law is a gross violation of one's civil rights. There was no trial, no witnesses were examined, and no evidence was presented. YouTube clips, hearsay, and news reports are not evidence.

@nandy1256 Like I said, you don't prove a negative. If there was an insurrection, then show me a person convicted of engaging in, or aiding and abetting, an insurrection. Nobody has even been charged. If it was an insurrection, it was one of the weakest insurrections in history. Unarmed people don't commit insurrections against an armed government. It was a riot, not an insurrection. And the events which led to the riot are still unclear.
