Article 30 of the Treaty of Lausanne on August 26, 1924 allowed the governments of the new States of Palestine, Syria, and Iraq to issue Nationality Acts. According to Norman Bentwich, the the British-appointed attorney-general of Mandatory Palestine the principle adopted was that Ottoman subjects habitually resident in the detached territories became ipso facto nationals of the State to which the territory had been transferred. The fact is that Palestine was a new state that came into existence in 1920 and that it had international rights and obligations, as such. Furthermore, the Allied and Central powers had explicit obligations under conventional international law to recognise the state of Palestine and deal with it as another state. Every time someone challenged Palestine’s statehood in any connection with a case before an international or national Court, dealing with the period prior to November of 1947, the decisions uniformly held that Palestine was a State – no “ifs, ands, buts, or maybes”.
