If the DOJ prosecuted someone not actively causing a threat, you can be 100% certain they would fight it in court and that part of the law would be struck down as unconstitutional. At least as far as it concerns non-violent protesters. Ted Cruz knows that, but he needs to be loud so he can be on TV.

  3. Free speech. The people have a right to "peaceably assemble." You arrest someone non-violent, that will get taken straight up the courts and struck down as unconstitutional. Stuck down by the same justices Republicans say are being harrassed.

  4. Well technically the leak from The Supreme Court wasn't classified. So no crime was actually committed by revealing the decision. The Court also decided to take it upon themselves to investigage the source of the leak. To protect the separation of powers.
