This "rarest of the rare" is quite a troublesome premise for death penalty. However, one can try to break the problem down a bit and approach it differently: * India averages about 45 (say 50) murders per million pa. One can safely argue that with this factoid that murder is a "rare" occurrence * Out of this 50, can one say that 1% will be "rarest of the rare"? It does sound reasonable ... * Approximating India's population to a round 1 billion, there are then 500 "rarest of the rare" cases every year * Since the turn of the millennium, India death sentencing rate is about 125 pa or 1/4 of 500 * So the thing to do really is to quadruple the death sentences awarded to average about 500 (Judiciary made an effort in 2018) * And, all these commutations to life by higher courts will not do at all. ( while written in half-jest & boredom, some human actions should get the actors vaccumed out of all human society, forever. If you find the idea of state taking life problematic on any/many levels then please figure out an "Australia"; SuperMaxes won't do as I won't be paying my taxes for those )
