One wonders why marital rape is not an offence in India. This is just another example of the fundamentally patriarchal nature of Indian Law, no matter what noises by legislators & judiciary are made about equality. The Supreme Court uses 142 as it pleases her (or would the honorable judges prefer the masculine pronoun here?) and finds it difficult to rule appropriately on marital rape?

@revanthganesh3808 This is a very dangerous argument. That a protective law is/can be misused is no argument against not having it at all ........Maybe a solution is that, as the govt. distributes free prophylactics to prevent pregnancy, govt should also freely distribute an upgraded version of that South African device Rape aXe to all married women in India and help set using it a social standard. Consent question can then devolve to 'who removed the device'... Would one like that?
