A poor guy wouldn't be giving away millions of dollars, but fair point, if it was a less rich person they'd likely already be arrested.

That's not going to happen in the next 8 days. An injunction is the best we can hope for right now, any legal action would have to happen after the election and if Trump manages to win, any federal charges would likely be pardoned by Trump.
