The federalist papers clearly state that the founding fathers did not want prosecutorial powers in the hands of the States in regards to a sitting president, for obvious political reasons. @jakeaurod

But that is for normal citizens, not a president and sorry to tell you he was tried for insurrection under the articles of impeachment and he was acquitted under the proper procedure, any other trial/charge would be double jeopardy. @jakeaurod

I don;t think that has been tested in this way. And a civil vs criminal trial can't produce double jeopardy anyway so not sure where you are going with that. And this line you keep going on about: "legislature or governor of a state, were empowered to make a simple finding and declaration that there existed a state of rebellion. " A state of rebellion is not a statement of guilt/participation, it is a declaration of an emergency event. @jakeaurod

You are all over the place. No one brought up anything you just said. Only a conviction can decide if Trump was guilty of being in an insurrection or any other crime, the SCOTUS would rule the process that would lead to a conviction, not if he was guilty or not. @jakeaurod

What insurrection? Has anyone even been charged with "insurrection"? As a Canadian and mostly centrist, I am baffled by all of it. There were no demands, hostages....nothing...only people you may disagree with politically.
