So, the lawsuit wouldn't be about a patent. That would immediately get thrown out of the court. That tells me that almost certainly what the lawsuit is about is trade secret which is a lot more fact intensive. But even that is going to require a bunch of documentation to prove that you did the work to protect the trade secret that everybody understood that it was a secret etc. I doubt they will win on that one trade secrets are pretty hard to prove. The other sort of thing I could see would be enforcement of a non-compete clause.
