Politicians back them had a different mindset from today's politicians. There was no military tribunal to charge someone for his war crime or anything. As the monarch of France, Napoleon was well respected, even though he was warmongering against entire Europe. Also, I believe other monarchs of Europe wouldn't want to be executed either if they lost wars and became to prisoners.
