Smith made the official request today, asking the nation's highest court to weigh in for the first time in history on the prosecution of a former president. This will decide whether or not politicians are above the law. The request is aimed at ensuring the election subversion trial stays on track for its March court date. Smith wants the court to skip past the federal appeals court and rule directly — to avoid any hiccups or delays. If the court takes up the request, they will be ruling on Judge’s Tanya Chutkan ruling that Trump is NOT immune from the election subversion prosecution.
