If Abbott knew that the migrants were in the country in violation of federal law and induced them to remain in the country with free bus tickets to their destination of choice while harboring them on his buses, he may have committed the felony offense of Smuggling of Persons. The law does not provide exceptions for actions taken by the governor or any other individuals. Therefore, if Abbott's plan violates federal and state laws, he could face legal consequences. It is important for everyone, including public officials, to respect the law and the rights of all people regardless of their immigration status.

The broad language of the bill has some experts fear it could be used to criminalize being transgender. Drag performers are defined as "male or female impersonators." The ACLU of Tennessee's Henry Seaton says that could impact LGBTQ+ Tennesseans across the board, not just drag performers. “It's ... this subtle and sinister way to further criminalize just being trans,” ACLU of Tennessee's Henry Seaton says.
