Because it was not an exact copy, it only used the same locking system in a different caliber, and it had been put in production, with new tooling and changes in respect to the prototypes, even before the prototypes had been throughly tested. There are many unreliable Browning short recoil pistols out there. That doesn't mean all the Browning short recoil pistols are unreliable.
