They would be able to give a decision with very little to do with Trump. CO SC decided to deliberately misinterpret a landmark SCOTUS case and basically said in their decision SCOTUS doesn’t understand their own decision. That alone could give them a 9-0 bitch slap without involving Trump because they’re attacking the court.

You’re misunderstanding the stay. If SCOTUS doesn’t consider it the CO decision goes into effect.

There have been follow up free speech cases that have also settled this issue. The “yelling fire in a crowded theater” as well was deemed legal speech. Yelling insurrection in a crowded Capitol would also be protected

No it’s just for the primary, general is federally dictated, although they probably would have the same issue they’d try to pull. Also CO GOP can’t switch to caucus without the approval of CO Secretary of State, since they’re the ones that have the suit there’s no way they’d accept a caucus.

@sociallyretarded4550 the CO SC attacked a landmark SCOTUS decision and basically said “well we’re ignoring this higher court decision because we don’t like it” that could lead to an easy dismissal because they just ignored precedent.

It isn’t just the president who enjoys these protections. Many who “act in the line of duty” avoid prosecution because they were “just doing their job”. Like the sniper who took out Vicki Weaver and a bunch of Branch Davidians.

Primaries are run on the state level. They wouldn’t be able to do the same at the federal.
