  1. You are kind of mischaracterizing the statement of that lady on the Majority Report. She is using the standard "ignorance of circumstance" swap method to lie about the current case. She isn't talking about a violent and malicious crazy person on a Subway, She is talking about a person having a seizure of some sort. When she says "they hit me a few times" she means "as they were flopping around incoherently" and not "was targeted directly with hostility and anger." She's saying that someone having a seizure shouldn't be choked if they bump you with a flailing arm" which isn't what happened to Penny and the other passengers.
