  1. Rightly or wrongly, I think the perspective of a lot of Japanese is that to be Japanese you have to be ethnically Japanese and culturally Japanese (likely from being born and raised in Japan). Deviate from that formula and you may be accepted, but perhaps not regarded as entirely Japanese. Certainly what is perceived is very different from any legalities such as what kind of passport a person is carrying.

  2. I was talking mainly about common perceptions not legalities. Also you missed the first part where I said you had to be ethnically Japanese AND culturally Japanese. If you are referring to the unfortunate case of Utinan Won, then he fails the first criteria because he is not ethnically Japanese. Both his biological parents were Thai. Also they were both in Japan illegally at the time. There are a great many countries where he wouldn't be a citizen, because they have removed (or never had) the principle of "Jus soli". Canada still has "Jus Soli", which has lead to an explosion of birth tourism.
