  1. The judgement that digging foundations was equivalent to mining is an idiotic stretch. Under that hare-brained notion, any construction that requires a foundation would be a "mine". Mining means digging to extract valuable MINERALS from the land, not digging in the land to enable construction. The judges involved should be bounced off the bench and disbarred for incompetence.
