Civil forfeiture is absolutely unconstitutional, but so is most of what the federal government does every day. This can not be ended by suing, it can only be ended by making it an issue in EVERY election. When you go to a candidate's public forum, DEMAND that they commit to ending it. Then, DEMAND that they make good on that promise. -jcr

Civil forfeiture is obviously forbidden by the excessive fines clause, and it exists today because of the dereliction of duty by every court that ever allowed it. When courts don't stop blatant plunder, government loses its claim to legitimacy.

"Qualified Immunity" has no basis in law whatsoever, and is obvioously preclueded by the Equal Protection clause of the Constitution. Its existence is the fault of the courts for dereliction of their duty to enforce the law when the culprits are government minions, and on the people for ever putting up with it at all.
