  1. If software vendors were liable for security failures in their systems then they would put more effort into securing them more robustly. You can't expect the general public to "not click on links" it just isn't realistic, and if your phones were not insecure in the first place such risks would be far less. Putting the onus on the end user is just an excuse to ignore who is really to blame for software and systems failing.
