Wrong. Plain view doctrine. Anything that can be seen from public can be filmed. And no you don’t own the airspace above your home.
11
The federal government claims complete and exclusive national sovereignty in the “navigable airspace” over the United States. Navigable airspace is defined as airspace where an aircraft can safely fly. Since drones, which are considered aircraft, can safely fly a few feet above land, the FAA suggests that modern ultra-low-flying drones extend federal sovereignty over navigable airspace all the way to the ground. Therefore, the airspace outside your bedroom window or above your pool is public domain, and cannot be “property owned or under the control of any other person.”

@kinflorida579 nope. We have no expectation of privacy in public.
7
@kinflorida579 yah that constitution is pesky.
5
@bay2michael it stood up in the Supreme Court. They ruled that if it can be seen from public it can be filmed. It’s called the plain view doctrine. Police use it everyday.
4
@kinflorida579 you are, put up a wall, keep your papers secure. Plain view doctrine says anything we can see is fair game. If I walk past your house on a public sidewalk I can look at and record anything I can see.
4
@geraldboesen5037 nope, your neighbor can look at your yard, record anything they see. Can’t trespass the eyes. Put up a wall. Keep your personal crap inside or buy enough property to keep them out. They can still fly over and look anytime
4
@geraldboesen5037 if I can see it I can film it even with a drone
3
@geraldboesen5037 the obligation to keep your info and crap private is on you. You must create the privacy
3
@DrStrange225 lmfao
2
@geraldboesen5037 I live in America and the first amendment applies here.
2
@kinflorida579 now let’s be clear, majority of police dept have rules in place against their depts doing this and the citizens can demand they don’t. Policies can be put in place to stop this. The law however allows it
2
@U.S.A.. nope free airspace
2
@andybeckett4340 no, but you can take pics of anything you can see from public. The airspace is public domain. Called the first amendment and been supported by the Supreme Court. Now referred to as the plain view doctrine. I get it there are only parts of the constitution you like
2
@samesryals6952 not the one who hates the first amendment
2
I pity you
1
@DrStrange225 not the one saying I hate well over half of Americans
1
@dner75-xh9le gripping. I feel sorry for your parents.

No it isn’t

Get over it. The federal government claims complete and exclusive national sovereignty in the “navigable airspace” over the United States. Navigable airspace is defined as airspace where an aircraft can safely fly. How is that familiar?
1
So a commercial airliner can’t fly over your home?
1
@thebronx-kr9ns if it can be seen from public it can be photographed. Build a wall. Put a net over your home. Cameras everywhere and they see whatever they can see. First amendment
1
@andybeckett4340 knock yourself out. At some point it does become stalking and you just showed us where. Like I’ve said you should take this up at town council meeting and set policies to your police. Most have rules against doing photography of the citizens at all. So the crying is nonsense. The first amendment allows me as a journalist to take pics of anything I can see
1
@andybeckett4340 no need they have traffic cameras, atms etc all taking pics every second. Commercial airliners fly over every few minutes and people are watching you. Get real
1
@samesryals6952 as I’ve said, redress your government. In reality you go to council meetings for your city and get policy in place that doesn’t allow them to do it. Most depts have those policies in place already so it’s mute in most places.
1
@samesryals6952 your ignorance is astounding
1
@bay2michael free airspace so it actually does. Case law backs it up.
1
@bay2michael only airspace restricted is over airports. Get a clue.
1
@bay2michael you have no expectation of privacy even in your own yard. Supreme Court ruled.
1
@bay2michael lmfao controlled airspace… what part of that don’t you morons get?
1
@bay2michael google it. Moron. Become a pilot
1
No it isn’t
1
@croberts2358 plain view doctrine. If you can see it from public.
