  5. The server should not have entered the garage. He was not invited in it appears. He should have stayed outside the entrance. The courts will decide regardless. He should have tricked her/asked directions, etc. but stay outside.

  6. You can't enter a building or residence without permission regardless of temperature. Residence includes an attached garage. Even when you're legally in a store you can't enter certain rooms without permission even if the door(s) to the room is open. This applies to Macys, Piggly Wiggly, Waffle House or Walmart; all.
