An assault is carried out by a threat of bodily harm coupled with an apparent, present ability to cause the harm. " The video clearly shows he did an action that did cause apprehension in the woman and could have been an harmful act. Most importantly he wasn't allowing her to do her job. In my book he assaulted her.
