  1. False equivalency. The 'rule' is regarding election of the President, because the President makes the appointment; this stops a termed out administration from making last minute lifetime appointments, to project their agenda into a successor's administration. The 'rule' is not meant to provide a midterm opportunity for the Legislature to BLOCK said appointment. Anyone who doesn't understand the difference, shouldnt be voting and any who pretends not to know the difference, shouldnt be in office, or on-air.
