Title 42 suspended title 8 laws and authority use to deter and penalize illegal border crossing. The Right was using it to undermine legal asylum under 8 US code 1158. It also suspends 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border illegally. And 8 US code 1326; stiffer penalties for crossing the border. That leaves out any legal penalty or deterrent for those crossing and stops legal asylum, with few exceptions under title 42. Makes it difficult to enforce immigration laws when Republicans are fighting in court to undermine our legal enforcement. With title 42 suspending enforcement that means many immigrants recross multiple times causing apprehension numbers to be inflated. The current rate of multiple returns is about 40% of border crossers. We had a 17 year decline in southern border crossing to the lowest point in 50 years prior to Trump and his polices. By 2019 Trumps policies doubled the number of people crossing the southern border to 977,000. He only saw a reduction for the first 9 months of 2020 due to covid, before it went back to a 20 year monthly high in October of 2020. It has remained a 20 year high and increasing ever since under Trumps failed policies and Title 42.

Go after him for what?

@FrankGallagherr And lack of evidence to support both claims.

Because the Right-wing base is easily manipulated by its puppet master

Democrats are following our laws the Republicans are not.

No the Right is just to low informed to understand.

@Baboon-nk4wq explain how dems are causing this?

@Baboon-nk4wq Due to false claims of voter fraud, asylee’s not showing up for court, criminal activity, and just right wing claims used to breed hate. The Right has unilaterally decided to undermine legal asylum. And have dubbed it as an open border policy and fed that buzz word to a roght wing base who have no understanding of immigration laws. Trumps zero tolerance policy to separate children, Remain in Mexico, Title 42. All attempts to stop legal asylum under US laws that have been in place for over 40 years. Yet now using it to trigger a base that is now openly full of hate on immigrants and this hate is now fed by GOP governors feeding off of that for votes from GOP supporters who immoral views support separating children as a deterrent, use of lethal force, lying to immigrants to ship them to dem cities to stick it to libs, incarceration, placing them in the hands of traffickers. All because of immigrants who may or may not have violated a misdemeanor that carries a civil penalty. And the Right wing base just does not understand our law.

@paulaharvey1171 Yes another Right wing peer review to try and prove the irrelevant to build a false narrative.
1
So the Right wing logic is that immigrants who are either trying to avoid government detection or are trying to stay legally, are risking that to vote in an election where there vote will hardly matter, when half of Americans don't bother to vote? And that makes since in your head?

I am sleepy, but I'm not as stoopid as the Right who think these people can vote.
1
They have been in place for over 40 years. Trump was undermining them to fit a Right wing agenda, Biden is back to following those laws now that title 42 is gone. Title 42 was closing our border, see how well that worked.

@sandyh5873 Please explain in detail exactly what immigration laws you have read and the statute number, that they decided to ignore.
1
@sandyh5873 Yes it does and Trumps Remain in Mexico policy would have violated that law(8 USC 1225), as they are to be detained in country. And after they are detained in the country they have the legal ability to be paroled or set on bond until that court date. It's been that way for decades. Just as catch in release is 8/USC 1125 and your open border policy is 8 USC 1158. The Right wants to undermine laws they do not support.
1
@sandyh5873 Asylum is a humanitarian process not punishment.
1
@sandyh5873 "The detention requirements of INA § 235(b) have been construed to apply to applicants for admission regardless of whether they are subject to a streamlined “expedited removal” process (e.g., those apprehended when attempting to enter the United States without valid entry documents) or are subject to formal removal proceedings (e.g., aliens inadmissible because of engaging in certain criminal activities). This construction also applies to aliens who, though initially subject to expedited removal, were found to have a credible fear of persecution if returned to their country of origin, and then transferred to formal removal proceedings to pursue asylum or similar forms of relief. DHS may “parole” an alien otherwise subject to detention under INA § 235(b) “for urgent humanitarian reasons or significant public benefit,” enabling the alien to be released from the agency’s physical custody. Unlike custody determinations under INA § 236(a), DHS’s parole decisions are not subject to administrative review. "

@sandyh5873 Now you know what the law clearly states.
