With title 42 gone we will be able to enforce our immigration laws to the fullest. Title 42 has no legal deterrent or penalties and is not an immigration law. It does side step those title 8 laws and why the Right wants to use it to undermine asylum, but that also removes the ability to enforce deterrents in title 8.

And the Trump administration and Republicans have been undermining Asylum laws since 2018. In that effort they caused this crisis and an inability to handle the overwhelming tasks of securing the border by removing the ability to use a legal deterrent for border crossers. The changes Biden made reversed changes that were made during the Trump administration back to previous rules. Those asylum qualification fall in line with what previous immigration courts have already ruled in appealed cases for asylum.

@satguy First thing they do is cross the border and request asylum, and that is legal. Yet the Trump administration was charging them with a crime and seperating their children, until federal courts reversed that policy. For those using the ports of entry, are turned away under Trumps policies and forced to remain in Mexico , also violation of immigration laws and international treaty. Then they misused title 42 to deny them asylum rights. When title 42 was to end last year the Right fought in court to continue to use it to deny asylum rights under our laws. All causing more to cross between check points, where there is no penalty while title 42 was in palce. The Right is doing nothing but undermining laws that enforce border security so they can limit our asylum laws.

Title 42 suspends title 8 laws and authority use to deter and penalize illegal border crossing. The Right is using it to undermine legal asylum under 8 US code 1158. It also suspends 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border illegally. And 8 US code 1326; stiffer penalties for crossing the border. That leaves out any legal penalty or deterrent for those crossing and stops legal asylum, with few exceptions under title 42. Makes it difficult to enforce immigration laws when Republicans are fighting in court to undermine our legal enforcement. With title 42 suspending enforcement that means many immigrants recross multiple times causing apprehension numbers to be inflated. The current rate of multiple returns is about 40% of border crossers. Right wing ignorance of our immigration laws, the process, and not knowing the effect of your parties policies is what caused this.
