Immigrants have a legal right to cross our border at any point without penalty and request asylum from a border agent and go through the process to confirm that asylum request (Title 8 USC 1158, article 31 of the Geneva Convention, and confirmed in East Bay Sanctuary vs Trump). That has been law for over 40 years. This is what the Right calls an open border policy. If an immigrant passes a creditable fear interview, they are to be detained in the US until that hearing (Title 8 USC 1125). They can be bonded or paroled until that hearing. And along with those trying to avoid detection and cross illegally in violation of title 8 USC 1325. That is a federal misdemeanor that carries a civil penalty. The Right felt justified to ignore and violate our immigration laws to stop the flow of immigrants. And used Trump to unilaterally undermine legal asylum to stop border crossings. Trumps immoral policies were to snatch children from legal asylum seekers as a deterrent, causing more to be sent unaccompanied. Trump used remain in Mexico to deny asylum seekers who used a port of entry to wait in Mexico at the hands of cartels and traffickers, instead of giving them protections under our laws. This caused more to cross between check points to get a better chance at an asylum claim around Trumps hardline policies. The Trump administration misused title 42, to cut off all asylum claims and enforcement of title 8 laws. This suspended our legal enforcement under title 8 and placed immigrants in expedited removal. Free to recross the border over and over without penalty. Essentially opening the border. Causing border crossing numbers to be inflated. We had a 11 year decline in southern border crossing to the lowest point in 50 years prior to Trump and his polices. By 2019 Trumps policies doubled the number of people crossing the southern border to 977,000. When Biden took office border crossing were at record levels under Trumps policies for 5 months strait. And title 42 was in place, but allowing for minors and families with small children to be allowed under our limited asylum laws for 5 year.
