  26.  @georgeh1131  Yes since Biden took office and a court decision changed who title 42 could exclude, we now process unaccompanied minors under title 8 1158 for asylum while title 42 is still in place. Prior to that no one was allowed into the asylum process under title 42. The Biden administration has been increasingly allowing more who have small children to be allowed with title 42 coming to an end. It still does not allow all asylum seekers to make the request and they are placed into expidited removal withoout being allowed to go through the asylum process due to title 42. And since our laws and treaty obligations will not allow us to penalize an asylum seekers for crossing the border of a safe haven country. We can not process them for their illegal entry under 8 USC 1325. They are just placed in expidited removal and then can not be charghed with stiffer penalties under 8 USC 1326. As clearly stated when title 42 is removed we will go back to using our titlew 8 authority to deport. So yes title 42 did suspend title 8 authority, it has been adjusted in the last year to allow more come through and processed under title 8. Title 42 needs to go away so we can go back to the title 8 authority that the Right has been undermining before title 42. What would be the purpose of title 42 still being in place? Why have the right been compretely open with the fact they want to keep title 42 in place to keep out "illegals" = legal asylum seekers.
