Those laws include asylum that the Right believe is a loophole in the law, because it allows immigrants to cross our border at any point and request Asylum. The Right has been unilaterally undermining this law for over 5 years and they callnit an open border policy and catch and release. That would be title 8 usc 1158 and 1225. The GOP constant attempts to stop those laws without going through congress is what has caused this crisis. The Right wing base likes to thinknthey are informed because they can parrot talking points, but the GOP has lied about our kaws andvyhe process for so long its left the base low informed and ignorant .

  6.  @Chaorchy  I have read that and I'm aware that it requires a treaty. And that a Trump appointed federal judge stopped Trumps use of that exception 5 years ago. That exception is embedded in title 8 usc 1158 and from 2020 to May 2023 title 8 was suspended under title 42. Biden's new immigration policy created at the end of title 42 includes the use of that exception and it was challenged in federal court and it was stopped in federal court again. A stay was placed on that court order while an appeal was scheduled this last December. I have not heard any decision from that appeal, but I did read about the courts arguments.

And yes it effected every entry along the border including legal asylum between check points. The first country exception is embedded in title 8 usc 1158. It has certain requirements for a country to qualify. There is no evidence of any country in this hemisphere that it applies to except Canada and the US. Federal judge appointed by Trump stopped the use of that exception under Trump 5 years ago, another federal court stopped Biden from using that exception this last summer in his new policy. From 2020- mid 2023, title 8 authority was mostly suspended under title 42, including this exception under title 8 USC 1158. Title 42 was forced in place by Steven Miller as another attempt to stop legal asylum. After the Trump administration and the border was open to travel, the GOP fought in court to keep title 42 in place to keep immigrants from being able to request asylum. While the Biden administration was fighting in court to end it as it is what is causing the border to be overwelmed.
