Biden did not reinstate catch and release. It was never gone; it is part of our INA laws 8 USC 1225. An asylum seeker is to be detained in the US if they pass a creditable fear interview and they can be bonded or paroled. Remain in Mexico would have violated that statute by forcing those who used a port of entry to remain in Mexico. It increased the likely hood of immigrants crossing between check points. Immigrants have a legal right to cross our border at any point without penalty and request asylum from a border agent, 8 USC 1158, article 31 of the Geneva Convention and confirmed in East Bay Sanctuary vs Trump. That has been law for over 40 years. This is what the Right calls an open border policy. Biden inherited border numbers that were already at record levels for 5 months before taking office. Congress is responsible for the border crisis, and Republicans clearly made it worse.

The law doesn't say we ignore all request for asylum because your puppet master say they are all not qualified before they reached border. And yes they are given legal advice on how to navigate through the legal process for asylum. A law you do not support. The first safe country exception does not apply to Mexico. A federal judge appointed by Trump stopped his use of that exception 5 years ago. Another Federal judge stopped Biden's use of that exception last summer. Under title 42, that Republicans forced in place, from 2020- mid 2023 that exception that is embedded in title 8 usc 1158 would have been suspended. The law is being followed by Biden. The attempts from the GOP to stop legal asylum us what caused this crisis .
