Republicans want to keep title 42 in place. Title 42 suspends all title 8 laws and authority. The Right is using it to once again undermine legal asylum, 8 US code 1158. It also suspends 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border. And 8 US code 1326; stiffer penalties for crossing the border. That leaves out any legal penalty or deterrent for those crossing. All we can do is deport, and many re-cross again with no penalty in place. That causes our apprehension numbers to be inflated and the get away numbers to be inflated...

you are partially correct, there is nothing in the constitution about immigration. There are laws passed by congress. And asylum seekers are not required to use a port of entry, they can enter at any point and request asylum without penalty. Title 42 suspends all title 8 laws including our deterrent and penalties for crossing the border illegally. What you call "catch and release" is US code 1158 section 1225, and it's a law.

how did they not side with the constitution here?
1
What can he do about the border when republicans are removing any legal deterrent in our immigration laws?
1
@ajaxwargod8229 fox appointed czar. And he is doing his job you should learn what it is.
1
@notanomad9320 branches of government have nothing to do with it. The same immigration laws have been in place for 40 years. They were working just fine before Republicans decided to unilaterally undermine our immigration laws.

@notanomad9320 the left is following the same immigration law that has been in place for 40 years. Laws that gave us a 17-year decline in southern border crossing to the lowest point in 50 years prior to Trump and his policies. The wall was a rally call for the low informed you support Trump. Trumps policy doubled that number of border crossers to 977,000 by 2019, a 20-year high. He only saw a reduction for the first 9 months of 2020 before going back to a 20 year monthly high in October where it has remained a 20 year high and increasing every since under Trump's failed policies and title 42. You have to learn our laws before making claims of them entering or being illegally, because for asylum there is no Is such thing. And you do not know our laws.
1
@notanomad9320 you should try and actually read the law and then you could take your head out of your ars long enough to know it's your leadership that us lying to you.
1
@notanomad9320 no one yet. Trumps remain in Mexico policy is in violation of US code 1158 section 1225. And has done nothing to secure the border. It's used on asylum seekers who used a port of entry .
1
@notanomad9320 neither, because I understand what is going on. It's not hard to understand when I'm not constantly spoon fed misinformation to manipulate the facts by the Right wing media and Leadership. Try some independent research of our laws and the process.
1
@notanomad9320 you don't seem to be able to read my post and understand the answer to your questions.
1
@notanomad9320 who said that dems or your talking head? Your talking head. What dems have said us the border is as secure as it's ever been, but if you don't have a clue what our immigration laws and the process, you can't know how secure it is. Crossing the border at any point and requesting asylum is legal and still a secure border. Getaways have always been an issue and so has drugs. It's just that the Right us a bit slow and easily triggered by what your leadership claims and you're clueless to your leadership creating this.
1
@notanomad9320 to enforce laws put in place by congress that were working before the Right caused thus mess.

you should read more instead of listening to false claims.
1
@stevesutton5498 because I don't care for Republicans unilaterally undermining immigration laws that have been working for years to fit their agenda, so they can cause a disaster at the border and then blame everyone else for what they caused out of their ignorance .
1
@stevesutton5498 and by the way to use that third country exception, would require a treaty between countries showing they can provide a safe haven for asylum seekers. We only have one with Canada .

@panms6776 no what it has on you, and your ignorance.

@kk-mc4sj read the law before making false claims as you clearly do not. I understand it's a right-wing thing to make sh it up that fits your narrative, and call it fact. Problem being our immigration laws are clearly written , and you guys can't get away with that sh it.
1
@kk-mc4sj I wonder why those numbers are high? Try reading my initial comment again, use some critical thinking and understand why those numbers are so high. Do you understand the concept of a useful idiot?
1
@kk-mc4sj §1158. Asylum (a) Authority to apply for asylum (1) In general Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien's status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title
