  3. Due to the Flores settlement unaccompanied minors and those apprehended with adults who have committed serious crimes cannot be detained with other adults. So, they are detained separately or in family units, if detention room is available for families while waiting processing. Crossing the border between check points is a violation of title 8 USC 1325. It is a federal misdemeanor that carries a civil penalty. Those making asylum requests while crossing between check points cannot be penalized for their illegal entry, title 8 USC 1158. Under Obama and other Presidents, the policy was to detain families together and process and release depending on asylum qualifications or deport if they do not qualify. Under Trumps zero tolerance policy created in 2018 anyone crossing between check points asylum or not was charged with a crime and the child was separated and later lost in the process. Trumps separation policy was in violation of the law and was reversed in East Bay Sanctuary vs Trump. Trump later would blame everyone else for this immoral policy he claimed he didn’t want to use, even when he had his legal team fight to keep it in appeal. Tom Homan and Trumps immoral supporters still to this day defend and support that policy. Trumps separation policy is why tax payers were being sued and why there were talks about settlements for 450k to immigrants. There was an article written about this issue with Trumps separation policy against legal asylum seekers, in that story a reporter used a stock photo of child detention centers that was during the Obama administration. And instead of the story of the children that were being harmed by Trumps policy gaining ground the right wing media deflected it to be about cages and claimed Obama was doing the same and fed that to a low informed Right wing base who believes every lie their puppet masters claim without ever looking at the context.

Scot Chief U.S Border Patrol SUBJECT: 42 U.S. Code Title 42 - The Public Health and Welfare U.S. Customs and Border Protection (CBP), and specifically the United States Border Patrol (USBP), are supporting the U.S. Government's response to the COVID-19 virus. Effective March 21, 2020 at 0001 hrs EST, USBP will exercise authorities derived under U.S. Code Title 42, Section 265,·'... suspension of entries and imports from designated places to prevent spread of communicable diseases... " as laid out in the attached Operation Order Capio. The Director of the Centers for Disease Control and Prevention (CDC), under the Authority of the Public Health Service Act, has directed CBP to prohibit the introduction of certain persons into the United States who, due to the existence of COVID-19 in countries or places from which persons are traveling, create a serious danger of the introduction of such disease into the United States. While operating under this authority, USBP will use Title 42 authority to immediately expel any individual encountered attempting to enter the United States in violation of travel restrictions. USBP will only apply Titles 8 and 19 authorities to subjects who are not amenable to expulsion under Title 42, or would otherwise be considered a high risk for the population (e.g., aggravated felons, relations to terro1ism, agent assaults, etc.). Watch commander approval is required for any authority used outside of Title 42 during this timeframe. "
