This is when you guys were calling for a border wall and the moderate Republicans and Democrats were saying for what? an issue that is in decline. By 2019, Trumps policies doubled the number of people crossing to 977,000, a 20 year high. He only saw a reduction for the first 9 months of 2020 (when the Right seem to believe all immigration started). By October of 2020, southern border crossings were back to a 20 year monthly high. It has remained a 20 year monthly high and growing ever since. When did Trump secure the border? He wasn't reforming immigration regulations. He was unilaterally undermining US immigration laws without going through congress. Most notably 8 US code 1158. Now the Right is undermining it again with title 42. And yes title 42 removes any and all title 8 enforcement laws for crossing the border illegally.

We have laws and statutes that have penalties and deterrents for crossing the border illegally and we have asylum laws that allow them to cross between check points and request asylum without penalty. Those laws are in our title 8 immigration laws in the INA. And they were working to reduce border crossings. Title 42 that Republicans are fighting in court to keep in place, suspends all title 8 enforcement. That means with title 42 in place there is no deterrent there is no penalty. All we can do is deport and they are free to cross again. This artificially inflates border crossing numbers. Let me know if your critical thinking is not able to understand this problem.

Title 42 just deports. it has nothing to do with asylum, it just suspends 8 US code 1158 that allows for asylum seekers to cross between check points. It in no way prohibiting them from returning for 5 years (East Bay Sanctuary vs Trump). A federal judge delayed the removal of Remain in Mexico, until all parties had time to file grievances of it's removal. On itself it is a violation of US code 1158 section 1225.
