Title 42 suspends all title 8 laws and authority use to deter and penalize illegal border crossing. The Right is using it to undermine legal asylum under 8 US code 1158. It also suspends 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border illegally. And 8 US code 1326; stiffer penalties for crossing the border. That leaves out any legal penalty or deterrent for those crossing and stops legal asylum, with few exceptions under title 42. Makes it difficult to enforce immigration laws when Republicans are fighting in court to undermine our legal enforcement. With title 42 suspending enforcement that means many immigrants recross multiple times causing apprehension numbers to be inflated. The current rate of multiple returns is about 40% of border crossers....

@tracybarhite1764 He's not exempting those countries from title 42. We just don't have diplomatic relations with those countries to return them there, while I may add those individuals are not being allowed to request asylum under title 8 as they should. They are being put into expedited removal with title 42 and not being allowed to go through the legal process of asylum in title 8. Yes a few are now allowed under title 8 because CDC lifted restrictions under title 42, a year before the CDC said title 42 was no longer needed. So don't sit there and act as if title 42 is not allowing us to enforce our laws, just because of a few exception.

@tracybarhite1764 Are you aware of the fact that 8 USC code 1158 allows any immigrant to cross our borders between check points and request asylum and we can not penalize them for their entry. even if they do not qualify we still can not penalize them all we can do is deport them. Only when they attempt to cross again can we charge them with stiffer penalties as a deterrent. This is not happening under Title 42 as they are now in expedited removal, and can cross again, without penalty under title 42. What part do you not understand?

@tracybarhite1764 I have on several occasions in this comment thread, shown exceptions that have been made to the use of title 42. The change you are speaking about was used in the 2021-2022 fiscal apprehension year. It would include immigrants who would be legally processed under title 8. Just as unaccompanied children, and family groups with small children at certain age groups, have had access since the beginning of the Biden administration. Title 42 was scheduled to be removed over a year ago. It is still in place because the right is fighting in courr to keep it in place, beyond it's need. Republicans have openly stated they want to keep it in place to continue to undermine our asylum laws. Their is right wing legislation to keep title 42 in place permanently. The Biden administration is doing what it can to follow title 8, short of ignoring the Right's motion for a stay on the removal of title 42. That will come this May, when the courts use of the administrative procedure act to keep title 42 in place will end. Stop trying to ignore my clear argument by digging at the minutiae, when you wont bother to do the same with the information you take from right wing sources. There are still many who cannot be processed under with our legal deterrent in 8 USC 1325 and 1326, because of title 42. We still do not have a legal deterrent in place for those who do not qualify under current title 8 restrictions due to title 42. It doesn't that we are now allowing those to come in that qualify. The problem is title 42 is allowing those who do not qualify to recross as many times they want. That is why title 42 needs to go.

@russty5692 from someone who has never bothered to read an immigration law.

Republicans are busy undermining immigration laws and manipulating their low informed base who know nothing of our immigration laws.
