@cmhardin37 our asylum laws require them to be on US soil. The point of asylum is being in the country that can provide the safe haven not available in their country or in any country south of us. We have a process in place if they don't qualify they are deported.

@hairyape3935 No they were recrossing the border multiple times as the penalty for crossing the border under US code 1325 is removed under title 42 and they are just sent back over the border and return again. Repeat violators under title 42 were at 7% under Trump, they are now at 40%.

@joannkennedy2932 Please be specific as to what SCUTUS ruled on, I'm curious of this decision your claiming. US code 1325 is the law that makes it illegal to cross our border. It carries a civil penalty for the first offence and carries higher penalties for repeat offences. Title 42 removes that penalty and immigrants are just deported and counted. Without penalty we are seeing an increasing rate of repeat crossers due to the fact there is no penalty under title 42. This also is causing border crossing numbers and data to be inflated. We have asylum laws US code 1158 this allows anyone to cross our border between check points and request asylum. It is a 40 year old laws and upholds our treaty obligations to asylum. Republicans attempt to keep title 42, is just one more Right wing attempt to undermine our long held asylum laws. THE Right can take both house of Congress I can grantee this, health authority will never become immigration law. You have no idea what you are talking about.

We had a 17 year decline in southern border crossings to the lowest point in 50 years prior to Trump and his policies. Within two year Trumps policies doubled the number of people crossing the southern border to 977,000 in 2019, a 20 year high. 2020 only saw a reduction for the 9 months before going back to a 20 year high by October 2020. It has remained a 20 year high and growing ever since under Trumps policies that failed. Biden is back to following laws that were working before Trump dismantled the process that was working. You don't know the law or what is going on at the border. Trumps illegal policies were trying to undermine laws that were working and the Right wants to continue that agenda.

What it means is we have separations of power and the limits to that power in the fed and the states. It means that Texas can't go to war with Mexico as it falls to the fed, and that would have to go through congress and not a dictator like you want in Trump.

The Right has failed in it's attempt to secure the border under Trump and has made the problem worse with his policies that violated immigration law. @Milosz24PL That's not a factual claim, nor is it relevant to the conversation. They still have a right to make the request without penalty. If they are rejected they are deported. With Title 42 in place nothing keeps them from coming back.

@av8rr Rights wing rhetoric is not law. The Right doesn't get to decide that every asylum claim is invalid before they reach the border to maker the request. We have laws and a process and those who do not qualify are deported. The Rights answer to everything is to attack the few committing fraud, by punishing everyone else who have valid claims.

@av8rr That number is made up even under Trump the rate was never that high, and is irrelevant they still have a right to make the request if they do not qualify they are deported. This is how the process works and how it's being done by the Biden administration vs the Trump administration who was violating that US law and denying the request and charging legal asylum seekers with a crime, so he could separate children to deter others from immigrating. Under Title 42 most asylum claims are denied, and no penalties are imposed for the violation of US code 1325. Thus causing more repeat crossers as there is no penalty for non asylum seekers, this is inflating the numbers at the border.

I didn't ask for Trump to violate immigration law, I didn't ask him to dismantle a process that was working before he took office, I didn't ask for the GOP to weaponize migrant children, I didn't ask the GOP to undermine asylum laws they don't support, I didn't ask for a continuation of title 42 that has made the issue at the border worse. I did ask for Biden to follow immigration law and put us back on track to the border security we had before Trump, that will not happen until we remove the rest of Trumps failed border policies.

They do not all quality for asylum but they do have a legal right to make the request and go through the process without penalty. The Right is trying to stop legal asylum.

Many show for their court date, just because Trump says otherwise doesn't make it a fact. US code 1325 does not apply to asylum seekers US code 1158 look it up, if you can read.
