  4. 8 USC 1158 is our asylum law that has been in place for 40 years passed by congress in 1980 they make the treaty obligation for asylum seekers we have through the Geneva convention part of US law. That US law is what you call an open border policy. What a true open border policy looks like is title 42 that Republicans are forcing to stay in place it suspends all of our laws used to enforce our borders.

If they are jot seeking asylum the first offense is a misdemeanor that carries a civil penalty. Under title 42 there is no penalty as all those laws are suspended. No more criminal then the last administration who had policies that violated US immigration law.

If you had any clue what you were talking about you would know that the third country exception does not apply to any of the countries south of the US as they do not qualify as a safe haven country We do not have a treaty with them that is required for that exception in our laws and in international agreements to the Geneva Convention. Our asylum laws were created in 1980 and were working just fine until Trump began undermining them. We had a 17 year decline in southern border crossing to the lowest point in 50 years prior to Trump and his policies. By 2019 Trumps policies doubled the number of people crossing the southern border to 977,000 a 20-year high. He only saw a reduction for the first 9 months of 2020 before we went back to a 20-year monthly high in October of 2020. It has remained a 20-year monthly high and growing ever since under Trump's failed policies.
