Title 42 suspends all title 8 laws and authority use to deter and penalize illegal border crossing. The Right is using it to undermine legal asylum under 8 US code 1158. It also suspends 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border illegally. And 8 US code 1326; stiffer penalties for crossing the border. That leaves out any legal penalty or deterrent for those crossing and stops legal asylum, with few exceptions under title 42. Makes it difficult to enforce immigration laws when Republicans are fighting in court to undermine our legal enforcement. With title 42 suspending enforcement that means many immigrants recross multiple times causing apprehension numbers to be inflated. The current rate of multiple returns is about 40% of border crossers. We had a 17 year decline in southern border crossing to the lowest point in 50 years prior to Trump and his polices. By 2019 Trumps policies doubled the number of people crossing the southern border to 977,000 a 20 year high. He only saw a reduction for the first 9 months of 2020 due to covid, before it went back to a 20 year monthly high in October of 2020. It has remained a 20 year high and increasing ever since under Trumps failed policies and Title 42.

@MrBadjohn69 Asylum seekers are not required to use a port of entry that is US law, internatinal treaty and confrimed in federal court. And under title 42 immigrats were being denied asylum, because the Right doesn't support legal asylum at any point.

@MrBadjohn69 I seem to remeber say US law and international treaty. Didn't I. And US law and our international treaty obligations both require that asylum seekers are able to cross the border of a safe haven country to request asylum without penalty. Thus being excempt from that crime. a crime that is a misdomeanro thjat carries a civil penalty. So I guess you don't hav a clue what our laws are.

@MrBadjohn69 You also do not understand the concept of a sanctuary city or the reason for the complaints. I have at no point said anything about supporting illegal immigration. You just don't understand our laws or the process as you have never read our immigration laws. There is no such thing as an open border. That is a buzz word the Right wing leadership use to manipulate their low informe dbase who do not have a clue what our laws are. We have an asylum law that allos immigrants to cxome to our border and request asylum. It has been in place for 50 years . The Right calls it an open border policy. It is 8 USC 1158.

@MrBadjohn69 yes the third country rule does not apply. International law and US law would require that those countries would have a treaty stating that they are able to provide the safe haven necessary for asylum seekers. We have that treaty with Canada but not any country south of the US. A Trump appointed federal judge tossed out the use of that exception 5 years ago.

@MrBadjohn69 asylum seekers can not be penalized for crossing the border of a safe haven country. That is US law 8 usc 1158, international law articles 31 of the Geneva Convention, and confirmed in federal court East Bay Sanctuary VS Trump.

@MrBadjohn69 many have accepted asylum in Mexico and they are way over capacity as well. And there arenany who are trying to reach families that are already here.
