The first country exception is embedded in title 8 usc 1158. It has certain requirements for a country to qualify. There is no evidence of any country in this hemisphere that it applies to except Canada and the US. Federal judge appointed by Trump stopped the use of that exception under Trump 5 years ago, another federal court stopped Biden from using that exception this last summer in his new policy. From 2020- mid 2023, title 8 authority was mostly suspended under title 42, including this exception under title 8 USC 1158.

It also suspended 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border illegally. And 8 US code 1326; stiffer penalties for crossing the border after deportation That left out any legal penalty or deterrent for those crossing and stopped legal asylum, with few exceptions under title 42. Makes it difficult to enforce immigration laws when Republicans are fighting in court to undermine our legal enforcement. With title 42 suspending enforcement many immigrants re-crossed multiple times causing apprehension numbers to be inflated. The current rate of multiple returns was about 40% of border crossers. We had a 11 year decline in southern border crossing to the lowest point in 50 years prior to Trump and his polices. By 2019 Trumps policies doubled the number of people crossing the southern border to 977,000. He only saw a reduction for the first 9 months of 2020 due to covid, before it went back to a 20 year monthly high in October of 2020. It has remained a 20 year high and increasing ever since under Trumps failed policies and Title 42.

@MikeW165 Yes and it seems to be the end of the talking points handed to the Right wing base. Until about a few weeks ago, when they came up with this new talking point of Biden having the authority to use executive authority. Those talking points seem to conflict with their impeachment claims, that he doesn't have the authority to ignore congressional laws.

Who is lying learn our laws and some facts that are not hand fed by those who do nothing but lie about the border.

If they are not qualified they are deported. The Right will not allow them to request asylum and assume they all do not qualify before reaching the border.

@5thribroarn304 And if they are in prison because their home country see homosexuality as a crime and they are seeking asylum for that persecutions in this country, that would be completely legal and a expectable asylum claim. And also a plausible reason why the Right keeps lying and undermining legal asylum.

I was giving just one simple example out of many reasons why they maybe prosecuted in their country, because you seem to keep needing to talk out your ars just to disagree with the left and not making any rational arguments for the Rights immoral behavior towards immigrants. The Rights goal is not to keep out those who already were not admitted under current law. The Rights goal was to deny asylum request.

@melgillham462 Did you happen to read where federal courts have stopped the use of that exception twice, and that tile 42 suspended that exception, and there is no evidence that a treaty exist that would qualify Mexico as a first safe country. So where was my opinion?

Due to false claims of voter fraud, asylee’s not showing up for court, criminal activity, and just right wing claims used to breed hate. The Right has unilaterally decided to undermine legal asylum. And have dubbed it as an open border policy and fed that buzz word to a right wing base who have no understanding of immigration laws. Trumps zero tolerance policy to separate children, Remain in Mexico, Title 42. All attempts to stop legal asylum under US laws that have been in place for over 40 years. Yet now using it to trigger a base that is now openly full of hate on immigrants and this hate is now fed by GOP governors feeding off of that for votes from GOP supporters who immoral views support separating children as a deterrent, use of lethal force, lying to immigrants to ship them to dem cities to stick it to libs, incarceration, placing them in the hands of traffickers. All because of immigrants who may or may not have violated a misdemeanor that carries a civil penalty. And the Right wing base just does not understand our law. Trumps immoral policies were violating US law by snatching children from legal asylum seeks as a deterrent. Harris was never appointed as border czar. There are no 85000 missing children and no they cannot use their drivers license to vote. The Right does nothing but lie.

@angieerickson2305 Because I'm not one making statements that show you have no understanding of how our voting process works. Immigrants who are able to legally get a drivers license can't use them to vote. Try learning the process instead of parroting your puppet masters who are lying to you.

Other than unaccompanied minors and families with small children who are excepted under our laws, the rest have been in expedited removal from 2020 to mid 2023 under title 42.
